Enforceable Contracts
Six Essential Elements of an Enforceable Contract In ordinary regular day to day existence contracts are used for different circumstances and reasons. A few agreements are all the more authoritative when contrasted with others dependent on the six components of offer, acknowledgment, thought, the partiesââ¬â¢ ability to get, the partiesââ¬â¢ plan to contract and the object of the agreement. This paper analyzes the previously mentioned components utilizing an agreement existing between a client and a telephone dealer. The telephone seller managed utilized yet clean telephones and in light of the fact that the client couldn't bear the cost of another telephone, he moved toward the telephone vendor who vowed to convey a practical and clean utilized PDA at the cost of $74 following two days. The installment was to be made after the conveyance of the telephone however depending on the prerequisite that the telephone would be completely useful and the client could restore the telephon e inside the next week in the event that it built up any problem. On the designated day, the telephone seller conveyed the telephone as guaranteed and the client made the installment as he had guaranteed as well. Following two days of utilizing the telephone the client began to encounter such a significant number of inconveniences with the telephone and it at long last went off totally. At the point when he restored the telephone to the telephone seller, the vendor disclosed to him that once the telephone was sold the client couldn't bring it back. At the point when the client took steps to sue him for break of agreement, the vendor avowed that there were no grounds in light of the fact that there was no composed contract. The client anyway went on with the suit in light of the fact that however the verbal agreement between them was at first satisfied through the conveyance of the telephone inside the selected time, it was penetrated when the seller wouldn't acknowledge back the telep hone inside the concurred beauty time frame. A break of agreement is characterized as any type of infringement that happens on conditions contained in an enforceable agreement. To determine the penetrate of agreement the initial step is confirming that an agreement existed between the client and the telephone vendor. This should be possible utilizing the six components of a contract. The telephone can be distinguished as the object of the agreement since it is legitimate determining the enforceable idea of the agreement. According to the principal component the verbal proposal of giving the telephone inside two days at $74 can be perceived as a feature of the coupling contract between the two paying little mind to the way that it was composed. Under acknowledgment or real consent, the client occupied with communicated acknowledgment of the proposal inside the specified conditions set by the seller. The shared guarantee between the client and the telephone vendor to eet their sides of the agreement can be compared to thought. Both the client and the vendor had the ability to contract since none was pressured into the understanding. The way that both consented to go into the agreement thinking about all the specified conditions, demonstrates their aim to go into the agreement. The above plainly shows that however no composed agreement existed between the seller and the client, a verbal agreement existed among them and the vendor penetrated the agreement by declining to respect one of the specified conditions in the contract. The significant two cures that could be used to counter the break of agreement could be the seller tolerating back the telephone and giving the client with another telephone or discounting back his cash as an out of court repayment in light of the fact that a court repayment can end up being pricey both on the vendor and the client or the client can feel free to sue with the point of securing a court repayment of the issue since the vendor was reluctant to acknowledge the first remedy.Though this would be expensive on them two, however the client has better odds of winning the case since he can without much of a stretch demonstrate that however a verbal agreement existed between them, it could be distinguished as an enforceable agreement utilizing the six basic components of an enforceable agreement. In light of this proof the court will see the telephone vendor as liable of break of agreement since he didn't meet one of the significant states of the agreement among him and the customer. This will come full circle into a stiffer discipline for the seller which would have been maintained a strategic distance from in the event that he met all the states of the agreement at first. All in all, however a verbal agreement existed between the seller and the client, it can even now be distinguished as an enforceable agreement utilizing the six basic components of an enforceable agreement and subsequently the telephone vendor is a t risk for the penetrate of agreement. 12 Tips That Will Help You Quit Smoking for New Years
12 Tips That Will Help You Quit Smoking for New Year's More in Addiction Nicotine Use How to Quit Smoking After You Quit Nicotine Withdrawal Smoking-Related Diseases The Inside of Cigarettes Alcohol Use Addictive Behaviors Drug Use Coping and Recovery Something about leaving an old year behind and looking ahead at the clean slate of a new one inspires most of us to try. We think about making lasting positive changes in our lives, and we do it with hope and enthusiasm. If youre planning to start the new year without a cigarette in your hand, set yourself up for success by learning what it takes to quit and what to expect from the process. Take advantage of the resources and support available online and in your local area as well. 1) Dont Let Fear Paralyze You Every smoker is well acquainted with the gut-wrenching fear that comes when the day theyve planned to quit smoking arrives. Youre suddenly filled with doubt about whether quitting is a good idea. Maybe you should wait until youre not so busy and stressed. Next week or month would be easier you tell yourself, as you light up and settle back into the haze of denial that comes with nicotine addiction. Dont let fear stop you before you get started. Push through and stub out that last cigarette when the time comes. You can do it and the rewards awaiting you are well worth the effort it takes to quit. 2) Use a Quit Journal Consider starting a quit journal and make the first entry the list of reasons you have for quitting. Take a look at an ex-smokers list of the pros and cons of smoking and use it for inspiration on making a detailed list of your own. We have a way of believing what we tell ourselves over and over. Your journal will help you cement your goals and give you perspective on the progress youre making with cessation. 3) Find a Shoulder to Lean On Encouragement and comfort from others who are interested in your success are crucial. Augment support from family and friends with online support forums, which can be a thriving, active group of people who are going through what you are, and are available 24 hours a day, 7 days a week. Stop in as a guest to browse and read posts from other ex-smokers, or register to post messages of your own. 4) Eat Smart Smoking cessation throws your body into shock initially. As damaging as the chemicals are in cigarette smoke, youve become physically accustomed to them and will feel their absence for a time when you quit. If you take care to give your body the fuel it needs to run properly, youll minimize and cope better with the discomforts associated with smoking cessation. A few treats are fine but dont load up on empty calories that leave you feeling tired and cause weight gain. Keep the right foods within easy reach. Its especially important right now. 5) Drink Water Water will help flush residual toxins out of your system and beat back cravings to smoke. When youre well-hydrated, youll feel better in general, which is a plus when youre going through nicotine withdrawal. 6) Get Your Beauty Sleep When youre tired, cravings to smoke will seem stronger and youll have less energy to deal with them. Fit a full 8 hours of sleep every night, and add a nap here and there if you need it. If you have trouble sleeping when you first quit smoking, try taking a long walk a couple of hours before bed. Insomnia can be a symptom of nicotine withdrawal. 7) Get Moving If you already have a daily exercise regimen, great. Keep it up. If not, start now. Choose something you enjoy doing, and youll be more likely to stick with it. Not only will it help you minimize weight gain, but exercise also creates endorphins, which will give you a feel-good boost. Aim for a half-hour of exercise every day. Walking is a low-impact activity that is suitable for most people and is a quick fix for the urge to smoke. Get out for a 15-minute walk around the block when youre feeling edgy and youll come back refreshed and relaxed. Be sure to check in with your doctor if you have any health issues that could be affected by a new exercise routine, especially if youve been inactive recently. 8) Renew Resolve Daily Your determination to quit smoking is built one simple day at a time. Every smoke-free day makes you stronger. It may not feel that way early on, but trust in the process and know that time is helping you to heal. Use the journal mentioned earlier to jot a few notes about your day before going to bed. Youll quickly see the progress youre making as the days pile up. When you consciously take time to reflect on the value of what youre doing, you fortify your will to make this the quit that lasts you a lifetime. 9) Be a Sponge We all know that smoking is bad for us, but if youre like most smokers, you avoid looking at the destruction that tobacco causes whenever possible. Take the blinders off and read everything you can get your hands on about the dangers of smoking. It will help you start to make the mental shift necessary to quit smoking successfully. 10) Accept and Let It Go Relax into your quit program and embrace cravings to smoke as they come. Dont fight them. Instead, try leaning into urges emotionally and let them run their course. Most cravings last 3 to 5 minutes. Think of them as signs that your body is healing because that is just what they are. 11) Dont Fall for Junkie Thinking Quitting tobacco is a gift, not a sacrifice. Dont sabotage yourself by feeling sorry that you cant smoke. You are choosing not to smoke because you want to be free of this killer of an addiction. Its all in your perspective. Pay attention and keep yourself in a positive frame of mind. 12) Be Patient Just as Rome wasnt built in a day, people dont quit smoking in a day or a week either. Most of us had 20 years or more of smoking under our belts before we stopped. Think of time and patience as quit tools. Work to undo old patterns and replace them with newer, healthier choices. Each day you complete smoke-free brings you closer to the lasting freedom youre after.Make this the year you quit smoking for good. You wont regret it.

The Theory Of Functional Analysis - 984 Words
The word ââ¬Å"Churchâ⬠to a religious person has more meaning than just a building where people meet once a week. To a religious person the word ââ¬Å"Churchâ⬠means the body of Christ. The body of Christ is made up of every personââ¬â¢s personal strengths that work together to form the entire body to live out a purpose. Churchââ¬â¢s operate on this manner; they do not see one another as superior necessarily, but rather everyone as equal and possessing their own strengths to create a fully operational team to glorify God. However, sometimes this system does not function correctly because of various issues such as a struggle for power, contrasting views and opinions, or lack of effort by people. We can apple the theory of functional analysis to the issues that arise in the Church. Functional analysis is the theory that society is made of many parts that work together to reach sociological equilibrium. This theory can be applied to how the Church operates because ev ery person within the Church must do his or her specific job in order for the church to remain in equilibrium. When people work together there are beneficial consequences of peopleââ¬â¢s actions also known as functions. An example of this would be the high school leadership team I am on at my church. Political Theory Discussion # 9 an Example of the Topic Economics Essays by
Political Theory Discussion # 9 by Expert Dr. Didion | 23 Dec 2016 American politics according to most political scientist is generally comprised of five fundamental building structures. This includes recognition of inpidualism, property, laws and contracts, freedom and finally, equality. Inpidualism has remained nowadays as a contentious concept. This can be traced back to the obsolete meaning of inpidualism which is commonly associated with "freedom from societal entanglement"(Dewey) and "cultivation and expression of personality"(Kateb). In this sense, inpidualism is expressed through "self profiteering" which could actually be detrimental to the whole politics. Need essay sample on "Political Theory Discussion # 9" topic? We will write a custom essay sample specifically for you Proceed Thus, asDu Boissuggest, there must be a new way of looking or understanding the term, inpidualism, so as, it would not conflict with the other tenets of politics. Inpidualism should be understand as a way of putting an inpidual into a societal context, and recognize that it is manifested asinpidual's "freedom of thought, working within and for a larger societal gain". Du Bois) Property is also subjected to changes in meaning, for what we regard as property today are very much different with the property as it was used in the past. The different forms of property and its conflicts with the other "important bases of politics" have also made this notion highly controversial. Laws and contracts, on the other hand, is really basic to any polical system. Contracts were acknowledge to be the manifestation of laws in a usually written form. Thus, any of our bills and the constitution itself, that were embodied in the sheets of paper or written on stones were actually a contract. The conflict here arises when the question of the supposedly impartiality of law was raised. Lastly, there were the concepts of freedom and equality, which are in the surface seems to be complementary, but are actually conflicting upon a closer look. While freedom talks about the absence of restraints, equality purports to the different entitlements that an inpidual is due to have. The more freedom the inpidual have, the more inequality it would result. Reform liberalism is all about having "inpidual obligations" to exercise one's abilities and to fully participate in the community". The basic values that reform liberalismpromulgates include: racial equality, gender equality, economic equality and cultural persity. Addressing these issues would suggest a long-range political view that could be use to resolve political conflicts and challenges. Thesepoliticalconflictsmay involve radical challenges from the left which are commonly from a working-class reform base. Some of the prominent challengers were Progressive Populism, Labor and the Rainbow Coalition. Populism had been ideal to gain public sympathy because they tend touphold the interest of the lower classes against tyranny and unjustified rules of the elite. It is a term used to denote "the government of the people". The Progressive Party has brought voices for protection of the lower classes from the elites. They have put more effort on proliferating the economy by making more roads, cutting off taxes, The American Labor Party, was a socialist party that greatly emphasizes the equality among property, resources and an unbiased law implementation in able to give security for the farmers and other members of the working class and are associated with the thought of uniting white workers with black workers. The Populist Party has been a significant historical party who has argued against setting of gold-standard. Most of its members were also farmers. They supported the Free Silver platform that has result in inflation. So far there had no Populist President that have existed, although there had been several Senators and congressman who belonged to the party, nonetheless, there were no President who was a member of the Populist parties and who advocate the partys goals. Lastly, the Rainbow Coalition was the first party to promote gay and lesbian rights, in a speech on July 17, 1984, Reverend Jesse Jackson said: America is more like a quilt many patches, many pieces, many colors, many sizes, all woven and held together by a common thread. The White, the Hispanic, the Black, the Arab, the Jew, the woman, the Native American, the small farmer, the businessperson, the environmentalist, the peace activist, the young, the old, the lesbian, the gay and disabled make up the American quilt. Indeed we are living in a two party system, but these does not mean that there cannot be a third party in the system, for there were instances wherein a third party or an independent candidate can also join the race like what have happen when Ross Perot ran for presidency. Only, the party which was called the Reform party have not flourished like the other two, this is due to the fact that there was neglect on the part of its members. They did not establish a single cut ideology that the other two parties posses. Living them out, dying in the race. With respect to Lieberman, he often calls himself a democrat, however the actions that he did in the past years of his career were obviously more of an action of a left republican or what was often called as mediators. Also, he was often endorsed by Republicans, his supporters were Republicans and his thinking can be associated more of a republican than as a democrat. Democratic Party has been supporters of the Libertarian movements and propagandas. They are in favor of the same-sex marriages, military diplomacy, and the secularization of the government and preservation of abortion rights. The Democratic New Leftist was concerned about the libertarian socialist tradition which is about the equality of the social and political system, eliminating all forms of civil hierarchies. The democratic Rightist or the democratic Conservatives were more inclined on preserving the social traditions and structures. Centrist Democrats differ from the other two factions in the sense that they support welfare reform and support the reduction of tax rates. The Republican Party is known to be economical libertarians and social conservatives. This is because they support the religious rights and other social rights while advocating economical inpidualism by promoting lower taxes and opposing abortion rights and same-sex marriages. They are also known to maintain free-market policies. The right wing republicans on the other hand, are those who are strictly conservatives that they were concerned about social aspects such as morality much more than economic gains. The left-wing republicans stressed on a more liberal approach than its right counterpart in the sense that they do support tax-cuts they are also supportive of partial-abortion rights. In the sense they espouse a semi-social liberal and economic liberal principle. The American Centrist party was largely about moving forward. It does not intend to be a rightist or a leftist. They believe that the government should be ruled by the people and that the current government is not working with respect to the best-interest of the American populace. The Republicans supports the idea of school voucher because they place more importance on the society and education is one of the things that can uplift the society. Most likely this will be the side of the Left-wing republican, who are in favor of helping the community to liberate itself through preparing the children for their future. However, the Flag salute and the school prayer will be most likely supported by the Right Republicans who were generally concerned in preserving traditional culture and heritage. Although there are differences between the position of the republicans regarding these matters, nevertheless, I believe that it is not a very great force that would split or change the political spe ctrum and position. Throughout the different notions that circle the realm of politics, one may be inclined to think that indeed there have been so many political issues that need to be addressed, and the answers to these problems as we have seen, so far, can only be answered by more than a dozen interpretations and personal opinions. Our needs and/or desires can be articulated in different ways, and still it might not reach the single line in the Bill of rights or in the Constitution. Policies were made in response to the different agreements and disagreements that are debated in Congress concerning the public interest . If political structure would be pide in the way we have above, the national two political party systems would have to be restructured in the sense that they would withhold compromises from the ideas presented by their respective right and left wings in able to create a more productive, conducive and aligned party systems. With respect to Perots candidacy, I believe that the reason why he did not won the presidency was because he have stopped campaigning and then go back on campaigning again. His platforms includes those issues that were not largely taken by or that were not included in the platforms by other candidates. As a independent candidate, he can be rendered as a left wing republican because of his support to free-trade and conservative social policies. I believe that the two-party system that we have is still the best way to organize a political structure, because even though it is a two-party system, it still leave space for detractors, debates, compromise and other opinion. Having a wide variety of party-system in my opinion would blurred the vision for national focus, but instead these parties would more likely seek favors and create policies that were catered for smaller groups of people. To investigate how surface area effects the rate of reaction in Calcium Carbonate Essays
To investigate how surface area effects the rate of reaction in Calcium Carbonate Essays To investigate how surface area effects the rate of reaction in Calcium Carbonate Essay To investigate how surface area effects the rate of reaction in Calcium Carbonate Essay This experiment is working on the theory of diffusion. Diffusion is the movement of particles. Three main things effect the rate of diffusion:- The distance of particles. Diffusion is quickest in gases as gas has a larger space between molecules making diffusion occur faster.- The energy of particles. The temperature effects the rate of reaction because the higher the temperature the faster the reaction.- The mass of particles. The effect of mass is caused by the relationship between the speed of particles and their temperature.Diffusion occurs in all the states of matter. However they most noticeably take place in liquids and gases. An example of this is Brownian Motion. Robert Browning noticed that when looking under a microscope pollen grains were moving in a random way. This movement is explained by assuming water molecules were hitting the pollen grains in a random way causing the pollen to move erratically.Brownian motion and diffusion provide evidence t o support the kinetic theory. The kinetic theory is kinetic energy cannot be created loss or destroyed. Instead it is converted to another form of energy. Particles have kinetic energy the energy of movement. Gases have the greatest kinetic energy and solids the least. This experiment also works on the Collision theory. Chemical reactions can be explained by the collision theory. For particles to react they must collide and they must have sufficient energy to react. There are many factors that effect the rate of reaction.- If the size of the reacting particles is decreased, there is more surface area available for reacting and so the speed of reaction increases.- When a solution becomes more concentrated, the number of particles present in the solution increases.- Increasing temperature increases the speed at which the particles move. Thus speeding up the reaction.Factors effecting the rate of reactionI am looking at the pros and cons of investigating each factor on the rate of reac tion.CatalystsPro- This speeds up the rate of reaction by helping bonds between atoms to break and form more easily. It is also reusableCon- The problem with this would be it makes this an unfair experiment unless you carefully measure out the same amount of catalayse.TemperaturePro-Heating it would speed up the experiment, and keeping it cold would slow it down. This is because if you heat it up it makes the water particles collide and move about more breaking up the marble chips faster.Con- Heating it is can be very dangerous and it could make the test tube explode.ConcentrationPro- You can see a definite difference if you use different concentrations.Con- It can be quite expensive using a large concentration of the chemical.Surface areaPro-Its inexpensive, practical and not dangerous.Con-It is a little inaccurate if not measured in exact sizes.ChoiceI have chosen to test the rate of reaction on surface area. This is because of all the reasons above can get around the con by using roughly the same size chip.PlanPre-testIve carried out the pre-test using different quantities of calcium carbonate and different quantities of Hydrochloric acid. The quantities with long and most vigorous reaction will be the quantity I will use in the investigation because it will give me a good set of results.ApparatusMedium sized Calcium carbonate chipsThree Test tubesScalesTimerMethod1. Measure 5g of calcium carbonate and measure 20ml of Hydrochloric acid.2. Put the calcium carbonate in the test tube, pour the acid in and quickly start the timer.3. Observe every ten seconds the weight of the marble chips and acid. Stop when the same weight occurs four times in a row.4. Repeat steps 1-3 with 10g of calcium carbonate and 40ml of hydrochloric acid.5. Repeat steps 1-3 with 15g of calcium carbonate and 60ml of hydrochloric acid.Results5g and 20ml of hydrochloric acid-Fast reaction and not very vigorous.10g and 40ml of hydrochloric acid-Long reaction and very vigorous.15g and 60ml o f hydrochloric acid-Long reaction and quite vigorous. Conclusion:This pre-test showed me that the best results to use in my investigation would be 10g and 40ml of Hcl. This was because this was the most vigorous and the longest results without wasting too much Hcl and Calcium carbonate.EvaluationThis pre-test was quite accurate. There was only one problem, acid was loss to the spitting I will use cotton wool to cover the top. The reason I will not use a cork stop is this will prevent all gas escaping. I will use wool because this will let gas escape but not acid.PredictionI predict that the large marble chips are going to take the longest to diffuse. The medium a fair amount of time to diffuse and the smallest chips will be the quickest to diffuse. I know this by my theory on diffusion and the collison theory. I know that If the size of the reacting particles is decreased, there is more surface area available for reacting and so the speed of reaction increases.EquipmentSmall, medium and Large marble chips.Conical flaskElectronic ScalesMeasuring cylinderHydrochloric acidCotton woolMethod1. Measure 10g of Marble chips in small, medium and large.2. Place the flask on the scales and take away the weight.3. Pour the large marble chips in the flask.4. Measure 40ml of hydrochloric acid and pour5. Quickly put the cotton wool on top and start the timer.6. Observe weight every ten seconds. Stop observing when the same weight repeats itself four times.7. Repeat steps 2-5 but use medium marble chips.8. Repeat steps 2-5 twice using small marble chips.9. Record all results in the table. The loss of mass is the largest in the big chips. However the loss in the medium chips is not as large as the small chips. The small chips loss of mass was consistent in the experiment. This is because the larger the surface area the faster the rate of reaction is. As you can see my results link back to my planning. In my planning it was said that if the size of the reacting particles is decreased, there is more surface area available for reacting and so the speed of reaction increases. This is true and matches up to my results.EvaluationMy experiment worked extremely well in t he plan but didnt work as well when I did the whole experiment. My results were not as accurate as expected. The flaws in my experiment were probably due to the following factors:* Timer wasnt started at exactly the time the marble chips went in.- To rectify this I will observe more carefully when to start the timer.* The cottons mass was not taken and deducted at the end.- I should next time take the mass of the cotton* Hydrochloric acid was not measured out properly.- I could maybe weigh the amount of hydrochloric acid used on some electronic scales.* Lots of people were in the room and were all walking about. People could have knocked the table causing the mixture to be swirled around a bit. Making the results slightly unfair.- I could possibly of done the experiment in a quite room on my own without distractions and lots of people walking about knocking the table.* The Calcium carbonate chips were not all the same size.- When choosing the chips I could of looked for similar size d chips to use so surface area was still the same. However even with these factors taken into account the experiment gave me my expected results. So I presume that these flaws in my experiment did not really effect the results. To further on my work I could look at how a catalyst would effect the rate of reactions. I could also look at all the other factor such as temperature and concentration and how they effect the rate of reaction.

ACT Scoring Error Did You Get Someone Elses Scores by Mistake
ACT Scoring Error Did You Get Someone Else's Scores by Mistake SAT / ACT Prep Online Guides and Tips Did you take the ACT and get a lower score than you expected? Do you think there may have been a scoring error? Maybe you filled in a section incorrectly or your exam wasnââ¬â¢t graded properly? Scoring errors on the ACT are rare, but they are possible, and there are ways to identify and correct these errors. This guide will go over the steps you need to take in order to verify your scores, as well as what you should do to improve your score on future ACTs if there was no grading error. Did ACT, Inc. Make a Mistake? Itââ¬â¢s very rare for ACT, Inc. to make a mistake when grading exams or reporting scores, but it does happen. Each year, hundreds of students who took the ACT request score verification, and some errors are found and corrected. ACT, Inc. does make mistakes, but it is important to know that these mistakes are very uncommon. The vast majority of students who take the ACT have their exam graded and reported properly. Before you begin the process of verifying your scores, you should be aware that the most likely scenario is that you simply didnââ¬â¢t do as well on the ACT as you expected you would. This can be disappointing to hear, and while you may wish this were a world where one day you come home to find a letter telling you that your ACT score is actually 5 points higher than originally reported, at some point you do have to overcome denial and focus on improving your scores for future exams. Potential Causes of Scoring Errors There are multiple reasons why a test may have been scored incorrectly. Below are some of the most common causes of scoring errors. Errors Caused by ACT, Inc. Sending a test taker the wrong score report. Incorrectly printing a question or section time on a test booklet. Problems with scanning answer sheets or essays. Errors Caused by the Test Taker Filling answers in for the wrong section. Filling in the wrong test identifying code. Writing the essay with pen instead of pencil Incorrectly filling in answer bubbles (not filling the bubble in all the way, not shading dark enough, etc.) How to Determine If There Is a Scoring Error If you're concerned that your ACT scores are wrong, you have two options: ordering a Test Information Release and requesting hand scoring. I'll go over what each of these involves in the order that I would recommend you approach them. Order a Test Information Release If after looking over your ACT score report you feel that you scored very differently from what you were expecting and donââ¬â¢t understand why, you can order a Test Information Release (TIR). A TIR provides you with a copy of all of the multiple choice questions from your ACT, a list of your answers, the answer key, and scoring instructions. This information allows you to see exactly which questions you answered incorrectly. If you took the ACT with Writing, you will also receive the writing prompt and essay scoring rubric. Even if you don't suspect a scoring error, TIRs can be useful as study material for future ACTs to help you learn what mistakes you made and what areas you need to improve in. ACT, Inc. offers the option to order a TIR when you register for the ACT, and you may have already ordered one. If not, you can order a TIR up to three months after you take the ACT. Note that TIRs are only available for ACTs taken on national test dates in April, June, and December, and they cost $20 to order. You can order one by filling out the form on ACT website and mailing it in. Once you receive your TIR, look over every question carefully. Are the answers the report says you marked the same ones you remember choosing? Now that you have the answer key, do you understand why those are the correct answers? It may simply be that you thought you were solving questions correctly but actually werenââ¬â¢t. If this is the case, skip down to the ââ¬Å"What to do if there wasnââ¬â¢t a scoring errorâ⬠section, and learn ways to raise your score for future ACTs. If something still seems strange, and your answer list doesnââ¬â¢t match with what you remember answering on the day of the test, you may want to order score verification (hand scoring). Score Verification Score verification, or hand-scoring, is a way to confirm your ACT scores if you feel your exam was graded improperly or if you think you may have marked your answer sheet incorrectly (such as filling in answers in the wrong section). You can request the ACT score verification service if, after ordering a TIR, you still believe your exam was graded incorrectly. In most cases you'll want to order a TIR before hand scoring because the TIR is cheaper and can give you a lot of useful information that, in most cases, convinces you that your test was graded properly. However, you can also order hand scoring without ordering a TIR first if you think there is an issue that will be solved by hand scoring. Reasons to request score verification before a TIR: You think you wrote your essay with pen instead of pencil. Your essay isnââ¬â¢t visible on your free score report. You think you bubbled your answers in on the wrong section. You think you used the wrong test identifying code. To request hand scoring, you need to fill out this request form and mail it to the ACT up to 12 months after taking the exam. You'll need to write in your name (the official one you used for the test), address, and date of birth along with the ACT ID, testing location, and test date from your original score report. Also include a check payable to ACT Student Services with the applicable fee. Score verification costs $50 for the multiple choice questions, $40 for the essay, or $90 to have both verified. Mail all of these materials along with your request for Score Verification to: ACT Student Services P.O. Box 414 Iowa City, IA 52243-0414 ACT Inc. will inform you by mail of the results of your score verification within three to five weeks. The letter will tell you if your original scores were confirmed to be correct or not. If an error was found, your scores will be changed and your corrected reports will be sent to all your previous score recipients (such as colleges you sent your scores to) at no cost. Your score verification fee will also be refunded. Itââ¬â¢s also possible for you to be in the room during the verification process, although you wonââ¬â¢t have access to the test questions. However, this option is not really necessary unless you are particularly worried about your test being scored incorrectly again. If you are interested in this, state it in the letter you mail along with the rest of the information to the address above. The ACT doesnââ¬â¢t provide a lot of details about this service, but they do state that extra fees apply. You may want to call ACT Customer Service at 319-337-1270 to learn more before requesting this option. Unlike SAT hand score verification, if you order hand scoring for the ACT, your score will never go down if an error is found that isnââ¬â¢t in your favor. Your score can only go up or stay the same if you request ACT hand scoring. Special note: In the past, if you ordered hand scoring for your ACT essay, your essay was be reread and rescored. Now, however, getting your essay hand-scored just means ACT, Inc. will confirm your essay was scored following ACT guidelines (two independent graders, with a third grader stepping in if the two scores differed by more than one point in any domain. Learn more about how the ACT essay is scored here. After going through the above steps, you will know whether or not the ACT made an error while grading or sending your scores. What if there was no mistake, and that really is the score you got? Read on to find out what to do. What to Do If There Wasn't a Scoring Error Donââ¬â¢t feel like it is the end of the world if your ACT score is lower than you thought it would be. Your standardized test scores are only one component of your application, and you may have time to retake the ACT and aim for a higher score. ACT Inc. offers a service that allows you to choose which ACT scores you send to schools. This means that, as long as the schools youââ¬â¢re applying to donââ¬â¢t require you to send all your ACT scores (and we have a complete list of the schools that require all ACT scores sent), then one low ACT score will not affect your application if you retake the ACT and receive a higher score. It's also normal for your ACT scores to fluctuate from one test to another. Drops in score of up to three composite points are normal and can occur just due to chance. This is especially true if you had a high score (30+) on previous ACT sections. Check out our guide to learn more about changes in ACT scores, whatââ¬â¢s normal drop in score, and what isnââ¬â¢t. Your scores may go down, but you won't be trapped in this creepy basement. How to Improve Your Scores Read on to learn specific strategies to help improve your scores on future ACTs. Identify Your Weak Areas Take some time to look over your TIR, if you ordered one. It has a lot of useful information and lets you see exactly which questions you answered incorrectly. Make note of the areas you answered the most questions incorrectly in and focus on them for your future studying. How can you improve a low section score? Check out these section-by-section guides: English The Top 9 ACT English Strategies You Should Use TheBest Methods and Strategies for ACT English Prep Math The 31 ACT Math Formulas You Need to Know More guides on everything from polygons to statistics Reading The Best Way to Practice ACT Reading How to Stop Running Out of Time on ACT Reading Science The Complete Guide to ACT Science 9 Reasons You're Missing ACT Science Questions Practice Donââ¬â¢t be unprepared for your next try at the ACT! Even though youââ¬â¢ve already taken the test before, you still need to study and practice for the next time. One of the best ways to do this is to take complete, strictly timed practice tests. Doing so will help you track your progress over time and help you identify where you are improving and where you still need to practice. Taking complete practice ACTs will also give you a more accurate estimate of what your score will be on a real ACT than simply taking one section at a time would. Review your results for these practice tests carefully so you learn what mistakes you made and how to avoid making them again in the future. You have to practice for the ACT, just like you would for a piano recital. (Colton Witt/Flickr) Consider Hiring a Tutor or Taking a Prep Course Sometimes, having a study plan developed by someone else is the best way to effectively target your weak areas and raise your score. There are a lot of great tutors and prep courses. Read our guide on finding the best tutor for you. Be Prepared on Test Day Simple logistics can be enough to have a significant impact on your test scores. On test day, make sure you are confident and prepared so you donââ¬â¢t let any outside circumstances affect your scores. Get enough sleep the night before the exam, bring a snack with you on test day, and know how to get to your test center. Having these things set will help you focus all your concentration on the test. Also, make sure you give yourself enough time before retaking the ACT. I recommend between two and four months so that you have enough time to practice and improve. Summary Itââ¬â¢s very rare for ACT, Inc. to send incorrect ACT scores, but it does happen. If you are surprised by how low your ACT scores are, there is a process you can go through to get your scores verified, but be aware the chances of your scores changing is very small. To verify your scores should first order a Test Information Release so you can see exactly which questions you answered correctly and which you answered incorrectly. Comparing your responses to the answer key may be enough to clear up the problem and let you see what you did wrong. However, if you still believe there was an error, you can request hand scoring to have your scores verified. There is a fee for both of these services, and they must be requested within three months of taking the ACT. If there was no scoring error, there are multiple ways you can work to improve your score, including analyzing your score reports, taking practice tests, and using a tutor or prep program. You can find more information about ACT score verification here. What's Next? Are you interested in a test prep program? PrepScholar has the industry's leading ACT and SAT prep program. Perfume Brands Calvin Klein & Bvlgari Essay Example | Topics and Well Written Essays - 500 words
Perfume Brands Calvin Klein & Bvlgari - Essay Example CKCC was a Unilever brand until few years back but its licensing agreement was then bought from Unilever by Coty Inc. Calvin Klein perfumes were known for its premium brand value and extremely good fragrance of all kinds. Eternity and Obsessions are the two popular perfume varieties of CK. These two are offered for both men and women. Bvlgari is the Italian luxury goods manufacturer. Like CK, Bvlgari too has wide array of luxury perfumes catering to the needs of men and women. Voile de Jasmin, Aqua, Pour Homme, Omnia and Rose Essentielle are the popular Bvlgari fragrances. All these names are well placed in the premium perfume segment. Together, CK and Bvlgari form the biggest names in the luxury fragrance industry. Main body Behind the huge success of the brands are not just the marketing activities alone. A major part of the success can be attributed to the perfumers who are in continual efforts to develop the best formula that gives the heavenly fragrance. There are basically two types of fragrances based on the skin scents. The first kind emits its own fragrance or forms the major portion of the overall smell. The second kind helps to enhance the skins own scent by giving it a better fragrance. Compared to CK, Bvlgari is more specialized in the second kind which is more unique. Another factor that differentiates both the brands is the customers that they target.

Ethics study case Essay Example | Topics and Well Written Essays - 1000 words
Ethics study case - Essay Example The case illustrates two applicable facts into principle of beneficence; the employerââ¬â¢s act not to remove or cover the asbestos rich cables threatens harm on the employeesââ¬â¢ lives while an act of whistle blowing threatens the organizationââ¬â¢s corporate image and legal liability. Confidentiality is another applicable principle to the case and defines the obligation to maintain privacy of a person or institutionââ¬â¢s sensitive information and whistle blowing puts the principle at stake. Lawfulness, another applicable ethical principle, defines the knowledge of laws and their implementation and applies to the organization that should be aware of and uphold health and safety laws and yet ignores the rules. The organizationââ¬â¢s failure to remove or cover asbestos pipes is wrong because it contravenes principles of beneficence and lawfulness. The conflict is prioritization of the interest to safeguard the job, employeesââ¬â¢ lives, and the organization and it affects the departmentââ¬â¢s employees at individual level, their families and the society at group level, and also the organization (Pfeiffer and Forsberg 15- 19). Options in resolving the problem from different ethical perspectives Utilitarianism defines ethics from an actââ¬â¢s consequence. ... re to asbestos, effects of the diseases on the employees such as death and incapacitation, and consequences on families and the society would however be more harmful than the companyââ¬â¢s financial loss in lawsuits and from poor corporate image. This is because loss of lives or body parts is more significant than financial losses that the company may incur. This justifies ethics in whistle bowing. The scope of deontology ethics that is based on rules and obligations also justifies whistle blowing that is supported by established laws on health and safety at the work place. This is because the organization has decided to operate contrary to the rules that establish its duty to ensure a safe work environment. The general obligation to ensure safety of other members of the society also justifies whistle blowing in the case. Virtue ethics, with its basis on character such as respect of peopleââ¬â¢s lives and welfare and integrity also identifies whistle blowing as the solution tow ards protecting the employeesââ¬â¢ lives by justifying an employeeââ¬â¢s integrity and strong personality in raising the red flag (Brooks and Dunn 182- 188). My perceived solution My perceived solution to the case is to expose the condition to relevant agencies for appropriate measures. This would involve a formal communication to the organizationââ¬â¢s management of intentions to seek external interventions towards protecting employeesââ¬â¢ welfare. I would then write to both the State Department of Health and the Environmental Protection Agency to inform them of the asbestos exposure at the workplace and the organizationââ¬â¢s position against removing or covering the asbestos cables. I would then submit a copy of each letter to the organizationââ¬â¢s management before remittance to the agencies. The proposed

Censorship Essay -- Essays Paper
Censorship After threatening the Communications Decency Act with a vetos of the past versions, President Bill Clinton signed the bill into law on February 8, 1996.1 Before hand, congress approved the largest change of the nation's communications laws in 62 years. One of the largest controversial topics included in the bill is the censorship of pornography, which now is a strenuously enforced crime of distributing knowingly to children under 18. The congress overwhelmingly passed the bill with a landslide 414-16 House vote and a 91-5 Senate vote.2 It seems now that the wide bill might not be what it cracked up to be, as it stands now, anyone who might upload James Joyce's Ulysses could be placed in jail for two years and have up to a $250,000 fine.3 Representatives of on-line services industries were concerned about the bill, and feared they could be held criminally responsible for Internet conversations.4 "We face a unique disturbing and urgent circumstance, because it is children who are the computer experts in our nations families," remarked a concerned Rep. Senator of India Dan Coats.5 Although in reality, censorship would do little to stop the pornography problems. The bill is a nation legislation trying to control a international network, which is virtually impossible. According to the First Amendment, Americans were granted to write anything they please, whether it's indecent or not, several series of judicial decisions also helped the freedom down the road.6 Nebraskan Democrat James Exon, put together an informational binder known as the Blue Book to show the Senate about the goings on within the Internet.7 Along the pages of the Blue Book were pictures of people bound and being burned by cigarettes, people pierced with swords and people involved in sexual activities with animals.8 The Senate, acknowledging their ignorance of the Internet, passed Exon's proposal after seeing the pictures in the Blue Book.9 Along with distribution of pornography, a person carries the chance of two years in prison and a $250,000 fine which is a good reason to restrict much of the flow.10 The Internet is extremely massive, filled with usenet newsgroups, web pages, IRC channels, ftp sites, gopher sites and much more. The Internet is the last and largest frontier of uncensored speech, anything from friendly chat to child por... ...ther person might be secretly trading child porn. With over 30 million users on the Internet, no one can guarantee that no pornography will stray down from someone. Bibliography "Background Information."
